Inventor Protectors
Your legal services are provided by independent, licensed patent attorneys — not sales reps, not employees. Their professional duty is owed solely to you.
For Sale By Inventor is a technology-enabled inventor platform operated by Montgomery IP Associates. Independent patent attorneys provide and oversee all legal services. Why Independent Attorneys Matter
Most invention service companies employ in-house sales representatives who earn commissions on the products they sell you. That creates a structural conflict: their paycheck grows when you spend more, regardless of whether spending more is the right move for your invention.
FSBI was built on a fundamentally different model. The attorneys who handle your patent work are independent practitioners — licensed by the USPTO, bound by professional ethics, and accountable to their own state bars. They don't work for us. They work for you.
The distinction matters. An independent patent attorney has a legal and ethical obligation to act in your best interest. A commissioned sales rep has an incentive to close the sale. These are not the same thing.
How FSBI and Independent Attorneys Work Together
Three distinct entities play defined roles in every FSBI engagement:
- For Sale By Inventor (FSBI) is the technology-enabled inventor platform and online marketplace. It's how you access research tools, track your project, and reach the marketplace.
- Montgomery IP Associates is the operating company behind FSBI. Montgomery IP employs the marketers, engineers, 3D artists, and support staff who produce your deliverables, manage onboarding, and run the platform.
- Independent patent attorneys provide and oversee all legal services — patent applications, prosecution, related counsel. They are not employees of FSBI or Montgomery IP Associates. Their professional duties are owed solely to the inventor.
This separation is intentional. It means the people building your marketing materials and 3D models (Montgomery IP) are distinct from the people advising you on patent strategy (independent attorneys). No one entity controls both sides, and your attorney's loyalty is never divided.
Commissioned Sales Rep vs. Independent Attorney
Here's the difference in plain terms.
Typical Invention Company
- Employs commissioned sales reps
- Reps paid more when you buy more
- No legal obligation to act in your interest
- May push services you don't need
- Legal work may be farmed out with no oversight
- Rep's duty is to their employer, not you
The FSBI Model
- Independent, licensed patent attorneys
- Bound by USPTO ethical standards
- Accountable to state bar associations
- Professional duty owed solely to the inventor
- Attorney oversees all legal work directly
- No commission incentive on your spending
What Attorney Independence Actually Means
When we say the attorneys are independent, we mean it in the legal sense:
- They maintain their own law practices, separate from FSBI and Montgomery IP Associates.
- They are registered patent practitioners with the United States Patent and Trademark Office.
- They are governed by professional rules of conduct enforced by their respective state bar associations.
- Their professional duties — including confidentiality, competence, and loyalty — are owed to you, the inventor, and to no one else.
Engaging with FSBI's platform does not create an attorney-client relationship with FSBI or Montgomery IP Associates. Your attorney-client relationship is with the independent attorney you work with directly.
